phudl.r connects hosts and their guests!
these terms and conditions ("agreement") govern your use of the mobile application ("phudl.r") provided by "phudl.r" pty ltd ("company"). by installing, accessing, or using the app, you agree to be bound by these terms and conditions. if you do not agree with any part of these terms, you must refrain from using the app.
App Description and Purpose
a phudl is an event, whatever you want it to be, and of course, people are involved! phudl.r allows hosts and their guests (phudl.rs) to experience the journey to the phudl together, providing the host with the information they need to make sure everything is prepared and ready to go, pending the arrivals. the app may include in-app purchases and location tracking features, which are subject to additional terms as described below.
In-App Purchases
some features, content, or services with the app may require payment ("in-app purchases"). by initiating an in-app purchase, you agree to pay the specified fees and charges associated with that purchase. in-app purchase may be subject to additional terms and conditions set forth by third-party payment processors or app marketplaces (eg: apple app store, google play store). it is your responsibility to review and comply with such terms.
User Accounts
in order to access certain features or services with the app, you will be required to create a user account. you agree to provide accurate, current, and complete information during the account creation process. you are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. you agree to notify us immediately of any unauthorised use of your account. You can close your account at any time. If you have active subscriptions through your app store, you will need to suspend or cancel them within your app store.
Location Tracking
the app may collect your location data to provide location-based services for the purpose outlined in the app's privacy policy. by using the app, you grant us permission to collect, store, and use your location data in accordance with applicable privacy laws and our privacy policy. you may be able to disable or limit the app's location tracking feature through your divide and app settings. however, doing so may impact certain functionality or services within the app.
Product Changes
We are constantly improving phudl.r and as such, over time, features may be added, changed, or removed. Phudl.r will not necessarily notify you of all changes, however, you will receive advice whenever the terms and conditions change.
Intellectual Property
The App and its content, including but not limited to text, graphics, images, logos, and software, are owned by or licensed to the Company and are protected by intellectual property laws. You agree not to reproduce, modify, distribute, or create derivative works based on the App without our prior written consent.
You retain ownership of any content you submit or post through the App. By submitting or posting content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purposes of providing and promoting the App.
Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without any warranties or representations of any kind, whether express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the App will be error-free, secure, or uninterrupted, or that any defects or errors will be corrected. You acknowledge that your use of the App is at your own risk.
Limitation of Liability
To the maximum extent permitted by law, in no event shall the Company be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from or related to the App or this Agreement, whether in contract, tort, or otherwise, is limited to the amount paid by you, if any, for the use of the App during the twelve (12) months preceding the claim.
Modification and Termination
We reserve the right to modify or update these terms and conditions at any time, effective upon posting the revised Agreement within the App. Your continued use of the App after any such modifications constitutes your acceptance of the revised terms.
We may terminate or suspend your access to the App, in whole or in part, at any time and without prior notice if we believe you have violated any provision of this Agreement or applicable laws.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Queensland, Australia. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the courts of Queensland, Australia, and you consent to the personal jurisdiction of such courts.
Entire Agreement
This Agreement constitutes the entire agreement between you and the Company regarding your use of the App and supersedes any prior or contemporaneous understandings or agreements, whether written or oral.
